Gittin (Jewish Divorce)

The Bais Din of Vaad Hadin V'horaah arranges Jewish divorces via the Get process. The Bais Din understands that the Get process often comes at a difficult and challenging time for the parties involved. With that in mind, the Bais Din expends its strongest efforts to ensure that the Get procedure is carried out in a sensitive and caring manner, while respecting the dignity and feelings of all participants in the process. Most importantly, the Bais Din adheres to the highest standards of Jewish law to ensure the universal acceptance of Gittin administered under its auspices.
WHAT TO KNOW PRIOR TO THE GET

Generally, the consent of both the husband and wife is required. A Get cannot be executed until the parties separate and live in different residences; however, a civil divorce need not be completed before the Get is delivered.

WHY IS A GET NECESSARY

In order to end a Jewish marriage, halacha (Jewish law) requires a Get. Without the Get (absent the death of one of either party), both husband and wife may not remarry under Jewish law.

THE GET PROCESS

The standard Get process is conducted in the spoken language of the parties and takes approximately 90 minutes. The officiating rabbi asks the parties various standard questions to ascertain their Halachic names (since the Get document must accurately identify the parties) and their consent to proceed with the Get process. The Get is written by a scribe and signed by two authorized witnesses. The husband then presents the Get to the wife in the presence of witnesses, thus effecting the divorce under Jewish law. Once the Get has been received by the wife, the Bais Din issues a certificate (the “p’tur”) to each party, indicating that a Get has been given and accepted and that each party is free to remarry.

MATRIMONIAL ARBITRATION

In addition to the Get process, the Bais Din maintains an active practice in matrimonial cases dealing with property division, child support, alimony, custody and visitation. If necessary, the Bais Din will convene a Din Torah (Jewish arbitration proceeding) in accordance with the requirements of Jewish law, comprised of expert dayanim (judges) experienced in adjudicating divorce cases.

The Vaad aims to have parties either come to an agreement between one another via mediation or have our Dayanim decide the issues in question, with such agreements and decisions being binding and enforceable under Halacha and secular law. The Bais Din maintains an impartial and confidential relationship with all parties to a Get. Additionally, the Bais Din maintains a team of professionals that focuses on the intake process, gathering all the necessary information from each party in order to provide for an orderly and expedited dispute resolution process. Finally, the Bais Din conducts its proceedings in a manner that is consistent with the requirements of secular arbitration law, so that the rulings of the Bais Din are legally binding and enforceable in the secular court system.

EXPERT JUDGES

Our Dayanim and resources include leading authorities on Jewish law, as well as lawyers and businessmen who are experienced and familiar with secular law and contemporary commercial practices. When appropriate, the Bais Din will include expert professionals on an arbitration panel or consult them as expert witnesses.

FEES

The cost of a standard Get is $1,200. Additional fees may apply for special or additional services.

DOCUMENTATION TO PRESENT

  • Kesuva (religious marriage document), if available.
  • Civil Proof of Marriage/Divorce, such as marriage license or final divorce papers.
  • Official state or federal ID, such as driver’s license or passport.
  • If a Get has been issued for a prior marriage, a copy of the P’tur (Certificate of Divorce).
